Terms of Service

These Terms of Service ("Terms") govern your use of the CarbMeNot mobile application and the website at carbmenot.com (together, the "Services"), operated by Skyble Lab Inc ("Skyble Lab", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate.

2. Health disclaimer — not medical advice

CarbMeNot is a food, carb, and macro tracking tool provided for general informational and educational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The Services are not a substitute for professional medical advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet, or nutrition program, and before making any changes to your diet.

If you have diabetes, are pregnant, have an eating disorder, or have any other medical condition, consult your healthcare provider before relying on the Services. Never disregard professional medical advice or delay seeking it because of information provided by the Services. Reliance on any information provided by the Services is solely at your own risk.

3. Accuracy of nutritional and AI information

The Services use artificial intelligence, food databases, and your inputs to estimate foods and nutritional values, including net carbs, calories, protein, and fat. These values are estimates only and may be inaccurate or incomplete. AI photo recognition can misidentify foods and portions. You are responsible for verifying the accuracy of any information before relying on it, especially for health-related decisions. We make no guarantee as to the accuracy, reliability, or completeness of any nutritional information.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.

5. Subscriptions and billing

Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store, subject to Apple's terms.

  • Auto-renewal. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Cancellation. You can manage or cancel your subscription in your App Store account settings. Cancellation takes effect at the end of the current billing period.
  • Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
  • Refunds. Payments are handled by Apple and are subject to Apple's refund policies. We generally do not provide refunds directly.

Prices and features may change; we will provide notice where required.

6. License and acceptable use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms;
  • Copy, modify, distribute, sell, reverse engineer, or create derivative works from the Services;
  • Interfere with or disrupt the Services or attempt to gain unauthorized access;
  • Use automated means to access the Services without our permission; or
  • Upload content that is unlawful, harmful, or infringes the rights of others.

7. Your content

You retain ownership of the data and content you submit (such as logs and photos). You grant us a worldwide, royalty-free license to host, process, and use that content as necessary to provide and improve the Services, consistent with our Privacy Policy. You are responsible for the content you submit and represent that you have the rights to submit it.

8. Intellectual property

The Services, including all software, text, graphics, logos, and trademarks, are owned by Skyble Lab or its licensors and are protected by intellectual-property laws. Except for the license granted above, no rights are transferred to you.

9. Third-party services

The Services rely on third parties, including Apple and cloud providers. Your use of those services is governed by their respective terms. We are not responsible for third-party services.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any information provided will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYBLE LAB AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

12. Indemnification

You agree to indemnify and hold harmless Skyble Lab and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in California, and you consent to their jurisdiction, except where prohibited by applicable law.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
